General terms and conditions

Article 1 – Definitions

In these Terms and Conditions, the following capitalized terms (whether in the plural or singular) shall have the following meanings:

• One-time maintenance: The one-time cleaning of the sewer and ventilation system at the request of the Client.
• Sewer and ventilation systemThe system includes the sewer system, including manholes, pipes, and any pumps, as well as the ventilation system, including mechanical ventilation units, heat recovery units, valves, and ventilation ducts.
• One-time cleaningCarrying out cleaning work on the sewer and/or ventilation system.
• One-time replacement: Replacing outdated or defective parts of the sewer and/or ventilation system.
• Client: The natural or legal person who enters into an agreement with RioVent Sewerage and Ventilation Technology for the provision of services, work and deliveries.
• RioVent Sewer and Ventilation Technology: The company RioVent Sewer and Ventilation Technology, located at Daalwijkdreef 47, 1103 AD in Amsterdam, registered with the Chamber of Commerce under number 91388546.

Article 2 – Sewerage and Ventilation System

1. For a one-time cleaning, replacement, or other maintenance, the Sewer and Ventilation System must meet the following requirements:
   • The system must not contain asbestos-containing materials.
   • The system must be free of obstructions such as cabling, wires, or other materials not native to the system.
   • The accessibility of the sewer and ventilation system must be good and safe, as assessed by RioVent Sewer and Ventilation Technology.
2. The Client guarantees that the Sewerage and Ventilation System meets the stated requirements.
3. For systems requiring special attention or provisions, the Client must inform RioVent Sewer and Ventilation Technology. Any adjustments will be determined in consultation with the Client.

Article 3 – Services

1. Prior to carrying out a One-off cleaning or other services, the Client will be informed whether there will be any deviation from these General Terms and Conditions.
2. The following conditions apply for a one-off cleaning or other maintenance of the sewer and/or ventilation system:
   • The One-Time Cleaning includes cleaning the system, inspecting its functionality, replacing any parts if necessary, and taking before and after photos.
   • Any costs for materials or labor in the event of malfunctions are not included, unless otherwise agreed.

Article 4 – Payments

1. Payment for the services provided will take place after completion of the work, unless otherwise agreed.
2. If you cancel an appointment within 48 hours of the scheduled date, a cancellation fee of €50 will be charged.

Article 5 – Liability

1. RioVent Sewer and Ventilation Technology strives to carry out its work with care, but accepts no liability for damage caused directly or indirectly by the work, unless there is intent or gross negligence.

Article 6 – Applicability of General Terms and Conditions

1. These General Terms and Conditions apply to all agreements between RioVent Sewerage and Ventilation Technology and the Client, unless otherwise agreed in writing.
2. Any invalidity of one or more provisions of the General Terms and Conditions shall not affect the validity of the remaining provisions.

Article 7 – Disputes

1. Dutch law applies to all agreements.
2. Disputes arising from or related to an agreement will be submitted to the competent court in the district where RioVent Sewerage and Ventilation Technology is established.

Article 8 – Amendment of the General Terms and Conditions

RioVent Sewer and Ventilation Technology reserves the right to amend these Terms and Conditions. Amended terms and conditions will be communicated to the Client in a timely manner.

Article 9 – Privacy

RioVent Sewer and Ventilation Technology processes personal data in accordance with applicable laws and regulations. Personal data is used solely for the performance of the agreement and will not be disclosed to third parties without the Client's consent.
